Stellantis is facing a proposed class action lawsuit over allegations that certain Ram ProMaster vans were marketed as having nine-speed automatic transmissions despite claims that two of those gears cannot be used during normal driving. The lawsuit argues that buyers paid for an upgraded transmission that allegedly provides fewer functional gears than advertised.
What is the problem?
The case involves 2022-2023 Ram ProMaster vans, and according to the complaint, Stellantis promoted these vehicles as featuring a new nine-speed automatic transmission, suggesting the additional gears could improve fuel economy, driving performance and engine efficiency. However, plaintiffs Victor Gonzalez and Stuart Glick allege that the eighth and ninth gears are effectively unusable because of the ProMaster’s size, shape and transmission software.
The lawsuit claims the vehicles are unable to reach the conditions needed to engage those higher gears during ordinary driving, leaving owners with only seven usable gears. The complaint further argues that the transmission therefore provides little of the benefit consumers would reasonably expect from a nine-speed system.
Plaintiffs claim Stellantis knew, or should have known, about the alleged limitation but continued advertising the vans as nine-speed models. According to the lawsuit, consumers could not identify the alleged problem before purchasing or leasing their vans and may have paid a higher price based on the advertised transmission specifications.
What owners should do
Owners of 2022-2023 Ram ProMaster vans who are concerned about the transmission should keep records of their purchase or lease, vehicle specifications, and any communications with Stellantis or a dealership.
It may also be useful to document concerns about transmission performance, including difficulty engaging higher gears or unusual driving behavior. Owners should retain relevant invoices and service records if the vehicle has been inspected or repaired.
